It is very easy to create a TOS php page, use this below (copy and paste) for the php page. Call it tos.php

You can create a text file in notepad with the code pasted in it, and then rename it to tos.php

Code:
<?php

// ####################### SET PHP ENVIRONMENT ###########################
error_reporting(E_ALL & ~E_NOTICE);

// #################### DEFINE IMPORTANT CONSTANTS #######################
define('NO_REGISTER_GLOBALS', 1);
define('THIS_SCRIPT', 'tos');

// ################### PRE-CACHE TEMPLATES AND DATA ######################
// get special phrase groups
$phrasegroups = array(

);

// get special data templates from the datastore
$specialtemplates = array(

);

// pre-cache templates used by all actions
$globaltemplates = array(
    'tos',
);

// pre-cache templates used by specific actions
$actiontemplates = array(

);

// ######################### REQUIRE BACK-END ############################
require_once('./global.php');

// #######################################################################
// ######################## START MAIN SCRIPT ############################
// #######################################################################

$navbits = array();
$navbits[$parent] = 'Terms of Service';

$navbits = construct_navbits($navbits);
eval('$navbar = "' . fetch_template('navbar') . '";');
eval('print_output("' . fetch_template('tos') . '");');

?>

Then create a new template (call it tos) ..... and paste this in there

Code:
$stylevar[htmldoctype]
<html dir="$stylevar[textdirection]" lang="$stylevar[languagecode]">
<head>
<title>Site Name - TOS</title>
$headinclude
</head>
<body>
$header
$navbar
<table class="tborder" cellpadding="$stylevar[cellpadding]" cellspacing="$stylevar[cellspacing]" border="0" width="100%" align="center">
<tr>
<td class="tcat">Terms of Service</td>
</tr>
<tr>
<td class="alt1">

[b]TOS GOES HERE[/b]

</td>
</tr>
</table>
<br />
$footer
</body>
</html>
